Process after filing a workers' compensation claim

It generally does not matter how much people like their jobs in Missouri, most people still need to go in order to earn income and provide for themselves and their families. So, for the most part people go to their jobs, do what they are required to do and go home afterwards. However, in order to be able to go each day, workers need to be healthy enough to do their job. If they have injuries or illnesses they may not be able to go and would not be able to earn the income.

Injuries can happen anywhere, but when they occur at work they can be particularly frustrating. However, workers know that when working with heavy machinery and other things, there are dangers involved. When the machines and other equipment do not work properly workers can be injured as a result and can leave them in a very difficult position both physically and financially.

Injured workers may be entitled to workers' compensation benefits though which can help pay for medical bills and some of their lost income. In order to receive these benefits though the worker must start a workers' compensation claim. Once that is started there is then a process that they must go through.

Within thirty days of the worker's claim, the employer must answer the claim and either admit or deny whether the worker is entitled to the benefits. If they admit it, the worker will begin receiving their benefits. If there is a denial, then there is a hearing where the worker must show that they are entitled to the benefits. After a judge makes a decision, either party can then appeal it, potentially all the way to the Missouri Supreme Court.

Unfortunately many workers in Missouri are injured on the job each year. These injured workers may be able to receive workers' compensation benefits though. However, employers may fight this and employees may need to go through hearings to receive what they deserve. Experienced attorneys understand this process and may be able to guide one through it.
